Sexual Misconduct and Harassment

Title IX of the Education Amendments of 1972 (20 U.S.C. §. 1681) was the first comprehensive law to prohibit sex discrimination against students and employees of educational institutions. It is one of several federal and state anti-discrimination laws that define and ensure equality in education.

Sexual harassment and sexual misconduct (including sexual assault, stalking, domestic violence, and dating violence) are forms of sex discrimination and prohibited by Title IX. Nashville State Community College is committed to the elimination of any and all sex discrimination, sexual harassment, and sexual misconduct on our campuses and in our education programs and activities.

It is the intent of the college to fully comply with Title IX of the Education Amendments of 1972, §485(f) of the HEA, as amended by § 304 of the Violence Against Women Reauthorization Act of 2013, the regulations implementing these Acts found at 34 CFR §.160.1 , §668.41, §668.46, and Appendix A to Subpart D of Part 668. 

 

Reporting Options

The college encourages victims of sexual misconduct/harassment to talk to somebody about what happened so they can get the support they need. 

Institutional Report

Law Enforcement Report

Victims of sexual misconduct may also choose to report the incident to law enforcement.  Law enforcement will conduct a separate, independent investigation.  To report sexual misconduct to law enforcement, contact Campus Police at 615-353-3273.

Confidential Report

Victims may prefer to report sexual misconduct in a confidential manner, rather than making a report to the college or law enforcement.  A list of confidential community resources is available below or by calling/contacting the Student Resource Manager at 615-353-3673 or the Student Resource Coordinator at 615-229-5586.  The college respects a victim’s decision to report confidentially; however, victims need to know that making a confidential report limits the College’s ability to investigate the incident or pursue appropriate resolution. 

Immediate Steps to Take Following an Incident

Regardless of which reporting option(s) victims choose, all victims are encouraged to take the following steps in the immediate aftermath of an incident of sexual misconduct:

To ensure valuable physical evidence is not lost following a sexual assault or incident of sexual violence, a victim should not:

It is important for a victim to seek medical attention immediately so that he/she can be screened for sexually transmitted diseases, pregnancy and/or drugs that may have been used to incapacitate, obtain emergency contraception and receive treatment for any injuries.  Valuable physical evidence can be obtained from the victim and the victim’s clothing. Even those who are unsure whether to make a police report or take action may wish to have a forensic examination, which will facilitate the identification and preservation of physical evidence.

 

Resources

Campus and Community resources are available to victims of sexual misconduct whether or not a victim chooses to make an official report or participate in an institutional disciplinary or criminal process.

 

Retaliation

Retaliation against a person who makes a report or files a complaint, participates or assists in an investigation, encourages another to file a complaint, or opposes Sexual Misconduct, or any other form of discrimination prohibited by institutional policy, is prohibited. Individuals must not interfere with an investigation. Retaliation will result in disciplinary measures, up to and including termination or expulsion.
